MINISTRY OF FINANCE, INVESTMENT & TRADE PLACES A CONDITIONAL MORATORIUM ON THE ISSUANCE OF BUSINESS LICENSES IN THE CONTRACTORS CATEGORY 

The Turks & Caicos Islands Government in an effort to undertake a comprehensive assessment of the contractors licensing category, has placed a six (6) month moratorium on the issuance of all new business license in the contractor category where the applicant is a non- Turks & Caicos Islander or in the case of a partnership or company where any shares are held by a non-Turks and Caicos Islander. 

Does this apply to renewals?

No, the moratorium does not apply to existing license holders only new applications.

Can I apply for a new license in this category?

Yes, however this is limited to Turks & Caicos Islander Status Holders only. In the case of a partnership all partners must be Turks & Caicos Islander Status Holder. Companies must also demonstrate that all shareholders in the company are Turks & Caicos Islander Status Holders.

License holders and applicants can visit the Inland Revenue Department at their offices in Grand Turk, Providenciales, or the District Commissioner’s Offices in the family Islands to complete and submit applications/renewal forms. Alternatively, licence holders can utilize the E-Services platform to submit applications or renew their business licence. The E-Services platform can be accessed via the following website: https://busreg.gov.tc/busreg/   or at http://www.gov.tc/revenue.

‘Business Licence Amnesty Period for the Waiver of Penalties’

The Inland Revenue Department (IRD) within the Ministry of Finance, Investment & Trade would like to inform the public that the House of Assembly at its sitting on 28^th March, 2022 passed the Business Licensing (Fees and Penalties) (Amnesty) Ordinance 2022 (hereinafter the Ordinance).  

The Ordinance permits licence holders who have accrued penalties on licences that were not renewed for the periods:

• 2018/2019;
• 2019/2020;
• 2020/2021; and
• 2021/2022.

to benefit from a waiver. In order to qualify for the waiver, the outstanding fees are to be paid before the end of the Amnesty period which is from 1^st April, 2022 to 30^th June, 2022. Should the fees not be paid during the Amnesty period, the penalties will be revived and will once again become due and payable as of 1^st July, 2022.

Licensees interested in benefitting from the Amnesty Waiver should visit the IRD at our offices in Grand Turk, Providenciales, or the District Commissioner’s Offices in the family Islands to make arrangements for payment commencing April 1^st 2022. Unfortunately, the E-Services platform cannot be used to facilitate renewals for those licensees that wish to benefit from the Amnesty Waiver. “End of Business Licence Renewal Period”

The Inland Revenue Department (IRD) in the Ministry of Finance, Investment & Trade would like to advise the public that business licenses for the financial year (FY) 2021/2022 will expire on 31^st March, 2022. License that expire on this date should be renewed immediately following as failure to do so is tantamount to operating without a license in contravention of section 3 of the Business Licensing Ordinance. A 10% penalty per outstanding month will be imposed on licenses which are renewed after Friday, April 29th, 2022. Additionally, previously the IRD had advised that it would not process new applications during the renewal period, the IRD will now however be processing all applications (new & existing) during this period.

In an effort to assist with the streamlining of the business license process, the IRD has issued the ‘Business License Guidance 2022/2023’ and the Clearance Guide. Both publications are designed to advise Taxpayers of the requisite obligations and requirements for obtaining a business license within the Islands. Taxpayers are encouraged to consult both publications prior to submission of an application for a new business license or a renewal of an existing business license.

The IRD would also like to take this opportunity to encourage licence holders to utilize the Department’s new E-Services platform to renew their business licence. The E-Services platform can be accessed via the following website: https://busreg.gov.tc/busreg/   or through the Revenue Department’s website: http://www.gov.tc/revenue.
